The Claimant, a large international bodog bonus code company, alleged damages related to interference with its contracts by a former bodog bonus code industry services licensor. Counsel for the Claimant retained Cornerstone Research to support Shane Johnson of Texas A&M University, who opined on damages.

Professor Johnson analyzed the economic damages to the bodog bonus code company resulting from tortious interference by the respondent. He also analyzed the respondent’s counterclaims regarding purported reputational and other harm.

Professor Johnson opined that the bodog bonus code company incurred damages as a result of the other party’s interference after the parties’ license had expired. He further showed that the respondent’s expert’s estimate of purported damages arising from the alleged reputational harm was fundamentally flawed and without basis. Professor Johnson explained that there was no evidence that the respondent suffered any reputational harm as a result of certain alleged actions by the bodog bonus code company, let alone that it incurred any lost profits or other damages as a result.

The arbitration panel ruled that the bodog bonus code company was owed the entire amount of tortious interference damages that Professor Johnson calculated, as well as prejudgment interest, other fees, and attorneys’ costs. The respondent was awarded nothing on its counterclaims.
