When an antitrust counterclaim arose in a trademark infringement suit, defending counsel retained Cornerstone Research to assess the economics of the antitrust allegations. We worked with Professor Kenneth Elzinga of the University of Virginia to assess questions of market definition and monopolization and with a marketing professor to examine new product development and brand equity. We helped both experts to prepare affidavits in support of a motion for summary judgment, which the district court granted in favor of our client. The Second Circuit affirmed this ruling on appeal.
