In initial litigation, Hyundai sued a Napleton Automotive Group dealership in West Palm Beach, alleging warranty fraud related to a vehicle recall. The dealership countersued Hyundai, claiming that the automaker had violated the Florida Dealer Act by unfairly allocating vehicles. Defense counsel retained Cornerstone Research to support Professor John Asker of the University of California, Los Angeles.

During the two-week federal trial, Professor Asker rebutted the counterclaimant’s allocation expert. He opined that Hyundai’s allocation systems are nondiscriminatory from an economics perspective and rebutted claimed damages.

The Florida federal jury ruled in Hyundai’s favor on all allocation counterclaims and awarded no damages.
