This included considering the empirical basis needed to prove liability as well as providing an estimate of potential damages. The plaintiffs, two senior executives at the defendant firm, alleged that they were discriminated against because of their race and/or national origin. Cornerstone Research collected detailed personnel, compensation, and promotion data and showed that there was no evidence of discrimination against the plaintiffs. Using regression analysis to predict compensation absent the challenged conduct, we calculated alleged back pay damages under the plaintiffs’ theory. We also calculated front pay damages by estimating future career paths and compensation. The case settled.
