In a case alleging infringement of a disposable diaper patent, the plaintiff, Procter & Gamble, presented a large damage claim based on “but-for” diaper purchases. Retained by the defense, Cornerstone Research and a marketing professor assessed the validity of the plaintiff’s model and showed that, under most plausible scenarios, there were no damages. The court found no liability.
